Welcome to EsellerShop. These Terms & Conditions (“Terms”) govern your access to and use of the EsellerShop website, marketplace, accounts, products, features, and related services.

1. About EsellerShop

EsellerShop provides an online shopping platform through which customers can discover and purchase products.

Actual product appearance may vary slightly because of photography, lighting, screen settings, manufacturing variations, or other factors.

5. Pricing & Availability

Product prices and availability are subject to change.

We make reasonable efforts to display accurate pricing and product information. However, typographical errors, technical errors, incorrect seller information, or other inaccuracies may occasionally occur.

If a material pricing or listing error affects an order, we may contact you regarding available options and take appropriate action consistent with applicable law.

Placing an item in your shopping cart does not necessarily reserve the item or guarantee its availability.

6. Orders

Submitting an order does not necessarily mean that the order has been finally accepted or shipped.

Orders may be subject to payment authorization, product availability, fraud or security review, seller acceptance where applicable, and other reasonable verification.

We reserve the right, where permitted by law, to refuse or cancel an order for legitimate reasons, including:

10. Order Changes & Cancellations

If you need to change or cancel an order, please contact Customer Support as soon as possible.

We will try to assist, but changes or cancellations cannot be guaranteed after an order has entered processing or has been shipped.

If an order has already shipped, the applicable return procedure may need to be followed.

11. Returns & Refunds

Eligible purchases may be returned in accordance with our Returns & Refunds Policy.

Unless otherwise disclosed for a particular product, our current policy provides a 30-day return-request period for eligible items following delivery, subject to the conditions and exclusions stated in that policy.

Certain products may be non-returnable or subject to additional conditions where appropriately disclosed and permitted by applicable law.

12. Marketplace Sellers

EsellerShop may allow independent sellers to offer products through the marketplace.

Where applicable, sellers are responsible for maintaining accurate information concerning their products, inventory, and other seller-controlled aspects of their listings.

Customers may be required to provide sellers with information reasonably necessary to process and fulfill purchases, such as order and shipping information.

If you experience a problem with a marketplace seller or product, please contact EsellerShop Customer Support so the matter can be reviewed under applicable policies.

Nothing in these Terms is intended to eliminate rights or remedies that cannot lawfully be waived.

13. Promotions, Discounts & Coupons

From time to time, EsellerShop or participating sellers may offer promotions, discounts, coupon codes, or special offers.

Additional terms may apply to a promotion, including eligibility requirements, expiration dates, product restrictions, minimum purchase requirements, or usage limits.

Promotional offers cannot be redeemed for cash unless expressly stated or required by law.

We may reject the fraudulent or unauthorized use of promotional offers.

14. Reviews & User Content

EsellerShop may allow customers or other users to submit product reviews, ratings, comments, photographs, questions, or other content.

You are responsible for content you submit.

You must not submit content that is unlawful, fraudulent, intentionally misleading, defamatory, infringing, threatening, abusive, malicious, or that violates another person's rights.

By submitting content to EsellerShop, you grant eSeller Store LLC a non-exclusive, worldwide, royalty-free license to host, reproduce, display, distribute, and otherwise use that content as reasonably necessary to operate, promote, and improve EsellerShop, subject to applicable law.

We may moderate or remove content where reasonably necessary to enforce these Terms or applicable policies.

15. Acceptable Use

You may use EsellerShop only for lawful purposes.

You must not misuse the website by attempting to:

• Commit fraud or make unauthorized transactions
• Access another user's account without permission
• Introduce malicious software or harmful code
• Interfere with website security or functionality
• Scrape or extract data through unauthorized automated methods
• Circumvent security or access restrictions
• Impersonate another person or organization
• Submit false or misleading information
• Abuse returns, refunds, promotions, reviews, or marketplace systems
• Use EsellerShop in violation of applicable law

We may restrict or suspend access where reasonably necessary to protect EsellerShop, its customers, sellers, or other parties.

EsellerShop may contain links to or integrations with third-party websites, payment providers, carriers, seller resources, or other services.

Third-party services are governed by their own terms and policies.

To the extent permitted by law, eSeller Store LLC is not responsible for the independent content, policies, availability, or practices of third-party services that it does not control.

19. Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ESELLERSHOP AND ITS SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, EXCEPT FOR WARRANTIES OR RIGHTS THAT CANNOT LAWFULLY BE DISCLAIMED.

WE DO NOT GUARANTEE THAT THE WEBSITE WILL ALWAYS BE AVAILABLE, UNINTERRUPTED, ERROR-FREE, OR FREE FROM EVERY SECURITY THREAT.

Nothing in these Terms excludes warranties, protections, or consumer rights that cannot legally be excluded or limited.

20. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, eSELLER STORE LLC AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM OR RELATING TO YOUR USE OF ESELLERSHOP.

Any limitation of liability applies only to the extent permitted under applicable law.

Nothing in these Terms is intended to limit liability that cannot lawfully be excluded or limited.

21. Fraud & Abuse Prevention

We may use reasonable measures to detect, prevent, and investigate suspected fraud, unauthorized transactions, account misuse, return abuse, promotional abuse, or other activity that may threaten customers, sellers, EsellerShop, or third parties.

Where appropriate and legally permitted, we may cancel transactions, restrict accounts, request additional verification, or take other reasonable protective measures.

22. Suspension & Termination

We may suspend or terminate access to EsellerShop where reasonably necessary because of serious or repeated violations of these Terms, fraudulent or unlawful conduct, security risks, abuse of our services, or legal requirements.

Termination does not eliminate obligations or rights that arose before termination.

23. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles, except where applicable federal law or mandatory consumer-protection laws provide otherwise.

Consumers may have rights under the laws of their state of residence that cannot be waived by these Terms.

24. Disputes

If you have a concern or dispute regarding an order or your use of EsellerShop, we encourage you to contact Customer Support first so we can attempt to resolve the matter.

Nothing in these Terms prevents either party from exercising rights or remedies available under applicable law.

I recommend not adding a mandatory arbitration clause or class-action waiver yet. Those provisions can have significant legal consequences and should be drafted specifically for eSeller Store LLC by qualified U.S. counsel rather than copied from another ecommerce website.

25. Changes to These Terms

We may update these Terms periodically to reflect changes in our marketplace, services, business practices, or applicable requirements.

When these Terms are updated, we will revise the “Last Updated” date.

Where required by applicable law, we will provide additional notice or obtain consent before materially revised terms become effective.

26. Severability

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will continue in effect to the extent permitted by applicable law.

27. Entire Agreement

These Terms, together with policies and terms expressly incorporated by reference, constitute the applicable agreement concerning your use of EsellerShop, subject to any additional terms that may apply to particular services, products, sellers, or promotions.
